1. Acceptance of These Terms

These Terms of Service, together with our Privacy Policy, form a binding agreement between you and FRIENDS OF JCC BUDAPEST, Inc. By accessing or using this website located at https://www.friendsjcc.hair, or by using any of our programs or services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the website or our services.

You confirm that you are at least the age of majority in your jurisdiction, or that you are using the website under the supervision of a parent or guardian who agrees to these Terms on your behalf. We may modify these Terms from time to time as described in the section titled Changes to These Terms.

Your continued use of the website after we post changes means that you accept the revised Terms. Please review these Terms regularly to stay informed.

2. Definitions

In these Terms, the words we, us and our refer to FRIENDS OF JCC BUDAPEST, Inc., a nonprofit organization based in the United States. The words you and your refer to any person or entity who accesses or uses our website or services.

The term website means this website and all of its pages and features. The term services means the community, cultural and educational programs we offer, as well as the computer systems design and computer integrated systems design services described on our Services page.

The term content means all text, images, graphics, logos, software and other materials available on or through the website. Capitalized terms used in these Terms have the meanings given to them in this section unless the context requires otherwise.

3. Use of the Website

We grant you a limited, non-exclusive, non-transferable and revocable license to access and use the website for your personal, non-commercial purposes, provided you comply with these Terms. This license does not include the right to copy, modify, distribute, sell or create derivative works from any part of the website without our prior written consent.

You agree to use the website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use of the website by, any third party. You are responsible for ensuring that your use of the website complies with all applicable laws and regulations.

We may change, suspend or discontinue any part of the website at any time without notice. We are not liable to you or to any third party for any modification, suspension or discontinuation of the website or any of its features.

4. Description of Services

Our organization provides two broad groups of services. The first group is our community, cultural and educational programming, which includes events, camps, lectures, volunteer opportunities and related activities that support the Jewish Community Center of Budapest. The second group is our computer systems design and computer integrated systems design services, described in detail on our Services page.

Any description of our services on the website is provided for general information only. Specific engagements, including any project scope, timeline, fees and deliverables, will be set out in a separate written agreement between you and us. The absence of a written agreement means that no professional engagement has been formed.

Where a separate agreement is signed, that agreement will govern the specific engagement to the extent it conflicts with these Terms, and these Terms will continue to govern all other aspects of your use of the website.

We may decline to provide any service to any person for any lawful reason, and we reserve the right to change the scope or availability of our programs and services from time to time.

5. Membership and Accounts

Certain features of our website or our programs may require you to become a member or to create an account. When you register, you agree to provide accurate, current and complete information, and to update that information promptly if it changes. You are responsible for maintaining the confidentiality of any login credentials and for all activity that occurs under your account.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss that results from the unauthorized use of your account, whether with or without your knowledge.

We may suspend or terminate any account at our discretion if we believe its use violates these Terms or poses a risk to our systems or to other users.

6. Acceptable Use

You agree not to use the website or our services to engage in any activity that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of the privacy of another person, or otherwise objectionable. You also agree not to impersonate any person or entity, or to misrepresent your affiliation with any person or organization.

You agree not to attempt to gain unauthorized access to any part of the website, to any server, or to any network connected to the website, and not to interfere with or disrupt the operation of the website or its underlying systems. You agree not to use any automated means, such as bots or scrapers, to access or collect data from the website without our prior written consent.

Any violation of this section may result in the termination of your access to the website and, where appropriate, in legal action. We may also report unlawful activity to the relevant authorities in our sole discretion.

7. Intellectual Property

All content on this website, including text, graphics, logos, icons, images, software and the design and arrangement of those elements, is the property of FRIENDS OF JCC BUDAPEST, Inc. or its licensors and is protected by copyright, trademark and other intellectual property laws.

Nothing in these Terms grants you any right, title or interest in our intellectual property except the limited license to use the website described above. You may not reproduce, distribute, modify, display, perform, publish, license, create derivative works from, or sell any content from the website without our prior written permission.

If you believe that any content on the website infringes your intellectual property rights, please contact us with a description of the work you believe has been infringed and the location of the material on the site, and we will review your notice promptly.

8. User Content

You may submit content to us through the website, such as messages through our contact form, comments, or materials you share in connection with a program. You retain ownership of any content you submit, but by submitting it you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify and display that content for the purpose of operating and improving our services and responding to you.

You represent that you own or have the right to submit any content you provide, and that the content does not violate the rights of any third party or any applicable law. We are not obligated to review, retain or publish any user content, and we may remove any content at our discretion.

You are solely responsible for the content you submit and for any consequences of submitting it.

9. Donations and Payments

If you make a donation or pay for a program or service through the website, you agree to provide accurate billing information and to authorize us to charge the relevant payment method. All amounts are stated in United States dollars unless otherwise indicated. Donations are generally non-refundable, except where the law requires otherwise.

We use third party payment processors to handle transactions, and those processors may apply their own terms and conditions. We are not responsible for errors or failures by a payment processor, and we do not store your full payment card details on our own systems.

If you believe a charge was made in error, please contact us using the details in the Contact Information section, and we will investigate the matter promptly.

10. Disclaimers

The website and all of its content are provided on an as is and as available basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the website will be uninterrupted, error-free, secure or free of viruses or other harmful components, or that any defect will be corrected. We do not warrant that the content on the website is accurate, complete or current, although we make reasonable efforts to keep it so.

Any advice or information you obtain from the website is provided for general information only and does not create a professional relationship unless we enter a separate written agreement with you.

11. Limitation of Liability

To the fullest extent permitted by law, FRIENDS OF JCC BUDAPEST, Inc., its officers, directors, employees, volunteers and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, loss of data, loss of goodwill, or loss of business opportunity, arising out of or related to your use of the website or our services.

In no event will our total aggregate liability to you for all claims arising out of or related to these Terms or your use of the website exceed the greater of one hundred United States dollars or the amount you paid to us, if any, in the twelve months preceding the event that gave rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some or all of the limitations in this section may not apply to you. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend and hold harmless FRIENDS OF JCC BUDAPEST, Inc. and its officers, directors, employees, volunteers and agents from and against any claims, liabilities, damages, losses, costs and expenses, including reasonable legal fees, arising out of or related to your use of the website, your violation of these Terms, or your violation of the rights of any third party.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with our defense of that matter.

This obligation survives the termination of these Terms and your use of the website.

13. Third Party Services

The website may contain links to third party websites and may integrate third party services, such as payment processors and event platforms. These third party services are provided by independent parties over whom we have no control, and we are not responsible for their content, availability or practices.

Your use of any third party service is subject to the terms and conditions of that service, and you should review those terms before using the service. We do not endorse and are not responsible or liable for any products or services offered by third parties.

Any interaction between you and a third party, including any transaction, is solely between you and that third party.

14. Termination

These Terms remain in effect until terminated by either you or us. You may terminate these Terms at any time by ceasing to use the website and our services. We may terminate or suspend your access to the website at any time, with or without cause and with or without notice, including if we reasonably believe you have violated these Terms.

Upon termination, your right to use the website will end immediately, but the provisions of these Terms that by their nature should survive termination, including the sections on intellectual property, disclaimers, limitation of liability and indemnification, will continue to apply.

Termination of these Terms does not affect any rights or obligations that accrued before the date of termination.

15. Governing Law

These Terms and any dispute arising out of or related to them will be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law principles. This choice of law applies regardless of where you access the website from.

You agree that the courts located in the State of Maryland will have exclusive jurisdiction over any dispute arising out of or related to these Terms, and you consent to the personal jurisdiction of those courts. This provision applies regardless of the location from which you access the website.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Dispute Resolution

We prefer to resolve disputes informally and efficiently. Before pursuing any formal action, you agree to contact us and to describe your concern in writing so that we have an opportunity to address it. We will make a good faith effort to resolve any dispute within a reasonable time, and in most cases informal discussion leads to a satisfactory result for everyone involved.

If we are unable to resolve a dispute informally within sixty days, the dispute will be resolved through binding arbitration or, where applicable law requires, through small claims court. Each party will bear its own costs of arbitration, unless the arbitrator determines otherwise.

Nothing in this section prevents either party from seeking injunctive or equitable relief from a court of competent jurisdiction where such relief is necessary to protect intellectual property or to prevent irreparable harm.

17. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, our services or the law. When we make changes, we will update the last updated date at the top of this page and, where appropriate, provide a more prominent notice.

Changes will take effect when they are posted on the website, and your continued use of the website after that date means you accept the revised Terms. If you do not agree with the revised Terms, you should stop using the website and our services.

We encourage you to review these Terms periodically so that you remain aware of your rights and obligations.
